Privacy Policy

Brain Innovation B.V. (hereinafter “Brain Innovation”, “we” or “us”) takes the protection of your privacy very seriously. We treat personal data confidentially and with due care. This Privacy Policy applies to personal data processed by Brain Innovation in connection with our websites and with customer purchase, licensing and support.

Brain Innovation is the controller for the processing described in this Privacy Policy. Our contact details are provided at the end of this document. We process personal data in accordance with applicable data protection law, including the General Data Protection Regulation (GDPR). This implies that Brain Innovation takes appropriate technical and organizational measures to protect personal data against unlawful processing, loss, misuse, unauthorized access, disclosure and alteration.

Websites

When you visit our websites (Brain Innovation and Brain Innovation), we may process technical information that is necessary to provide the websites and keep them secure, such as IP address, date and time of access, requested pages, and information about your browser and device. We use this information to operate and protect our websites and to prevent misuse.

Information about Google Analytics

We may use Google Analytics to obtain statistics about how our websites are used (for example page views, approximate source of visits and time spent on pages). We use these statistics to improve our websites and the information we provide. Where required by applicable cookie rules, we only use analytics cookies after you have given consent. You can withdraw your consent at any time by adjusting your cookie preferences (where available) or by deleting/blocking cookies in your browser.

What are cookies?

A cookie is a small text file that a website saves on your computer or mobile device when you visit the site. It enables the website to remember your actions and preferences (such as login, language, font size and other display preferences) over a period of time, so you don’t have to keep re-entering this information when you come back to the site or browse from one page to another.

How do we use cookies?

A number of our pages use cookies to remember:

The cookie-related information is not used by Brain Innovation to identify you personally. Cookies are not used for any purpose other than those described above.

You can delete all cookies that are already on your computer and you can set most browsers to prevent them from being placed. If you do this, however, you may have to manually adjust some preferences every time you visit a site and some services and functionalities may not work.

Your Rights with Respect to your Personal Data

You have the right to request access to, rectification or erasure of, your personal data, as well as restriction of processing, to object to processing, and to data portability. Where we process data based on consent, you may withdraw consent at any time. You also have the right to lodge a complaint with a supervisory authority.

Where we process personal data on the basis of consent (for example, for certain cookies), you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent before its withdrawal.

You also have the right to lodge a complaint with a data protection supervisory authority.

We do not use automated decision-making or profiling that produces legal effects concerning you or similarly significantly affects you.

Sales and Support

Brain Innovation will only use your data if it needs your data to deliver (or has delivered) products (software) to you, or when providing support to help you use its software products. After purchase of Brain Innovation products, your data is stored in order to handle (subscription) licensing and to inform you about important software updates.

We typically process personal data such as your name, affiliation/company or institution, business contact details (including email address), licensing and subscription information, and the information you provide to us in support requests (including any files or screenshots you submit).

Legal Basis

We process personal data for sales, licensing and support primarily to perform a contract with you or to take steps at your request prior to entering into a contract. Where applicable, we also process personal data on the basis of our legitimate interests in efficient customer administration, licensing management, product support and service improvement.

Service providers (processors)

For these purposes we use external IT service providers (processors), in particular cloud-based collaboration, ticketing and helpdesk systems, that process personal data on our behalf and in accordance with our instructions. We have data processing agreements in place with such service providers. Some service providers are located in the European Union and some may be located outside the European Economic Area (EEA); in the latter case we ensure appropriate safeguards for international transfers, for example by using standard contractual clauses approved by the European Commission. Brain Innovation does not sell your personal data and does not allow our service providers to use it for their own purposes. Our employees and service providers are obliged to respect the confidentiality of your data.

Data required

If you do not provide the personal data necessary for licensing and support (such as contact details and relevant case information), we may not be able to supply our products, administer licenses/subscriptions, or provide support.

MRI data (support)

If a support case involves sending MRI data sets to Brain Innovation’s support employees, data is only accepted if you ensure that it is properly anonymized. Anatomical MR data must also be made unidentifiable by using a defacing or skull stripping routine. Brain Innovation will delete such data one month after the support case is closed, or at any time that you request deletion.

Data Retention

Brain Innovation retains personal data for as long as your license subscription continues or for as long as is necessary to deliver our support services and to meet applicable legal obligations. If you decide to stop using our software products, we will delete your personal data at your request, unless we are required or permitted by law to retain certain information for a longer period.

Changes to our Privacy Policy

This Privacy Policy may need updating as a result of changes in applicable laws or changes in our business or services. We therefore advise you to read this Privacy Policy on a regular basis to remain up to date. If Brain Innovation makes changes that materially alter your privacy rights, Brain Innovation will provide additional notice via email.
